Liability Waiver
RELEASE OF LIABILITY AND WAIVER OF CLAIMS
STUDIO & ONLINE RELEASE
ALL Studio (hereunto referred to as “ALL”), strongly recommends that you consult your
physician before starting any exercise program.
In consideration of my participation in the activities to be held at ALL Studio (the
“Activity”) located at 411 Alexander Street, Vancouver, BC, V6A 1E1 (the “Premises”),
which Premises is leased by Aritzia LP, I agree as follows:
- I confirm that I have no health problems (including, without limitation, cardiac
irregularities; spinal bone, joint, tendon or ligament injuries; spells of dizziness; asthma
or other breathing difficulty; diabetes; epilepsy or any allergy) which may affect my
participation in the Activity. I understand that I am voluntarily participating in a program
of strenuous physical activity. - I understand that I am required to follow the instructions of the instructor at all times.
I understand that advice provided by our instructors at no time constitutes medical
advice in substitute for advice provided by a medical professional. - I recognize that there are risks in participating in the Activity and that injuries are a
common and ordinary occurrence of the Activity. Injuries may include, without limitation,
heart attacks, muscle strains, broken bones, shin splints, back injuries, or soreness, and
may occur during or following my participation in the Activity. - I am aware that there exists the possibility of certain conditions occurring during or
following my participation in the Activity, including, without limitation, light-headedness,
fainting, or abnormal blood pressure or heart rate. I voluntarily elect to participate in the
Activity. I hereby agree, freely and expressly, to ASSUME AND ACCEPT ANY AND ALL
RISKS OF CONDITIONS, INJURY AND DEATH to me arising directly or indirectly from
participating in the Activity (including, without limitation, loss or damage to my person or
property). - I hereby release and agree to hold harmless, indemnify and defend ALL Movement,
Inc., Aritzia LP, and their respective partners, subsidiaries, parent companies, affiliated
companies and all of their respective officers, directors, employees, contractors,
shareholders and agents (collectively, the “Indemnitees”), from and against any liability,
claims, demands, actions and causes of action whatsoever arising out of or related to
any loss, cost, property damage, injury and/or death, that I may sustain while, or as a
direct or indirect result of, participating in the Activity, regardless of fault. - By my agreement of this Release, I shall indemnify the Indemnitees for any injury to
other person(s) or property which I may cause, directly or indirectly, as a result of
engaging in the Activity. - I agree that any and all disputes between me and the Indemnitees arising from the
Activity, including without limitation the terms of this Release, shall be governed by and
construed in accordance with the laws of the Province of British Columbia. - In the event any part of this Release is found to be invalid or unenforceable by a court
of competent jurisdiction, the remaining terms hereof shall continue to be fully
enforceable. - THIS RELEASE SHALL BE BINDING UPON ME TO THE FULLEST EXTENT
PERMITTED BY LAW and shall be binding upon my heirs, executors, personal
representatives, and administrators and may be pled by the Indemnitees as a complete
bar and absolute and unconditional defense against any claim, demand, action or cause
of action by me or on my behalf.
I CONFIRM I HAVE CAREFULLY READ THE FOREGOING RELEASE,
UNDERSTAND ITS CONTENTS AND AGREE TO IT WITH FULL KNOWLEDGE OF
ITS SIGNIFICANCE. THIS RELEASE IS GIVEN TO THE INDEMNITEES IN
CONSIDERATION FOR MY PARTICIPATION IN THE ACTIVITY.
